Lease Buyout Guide

Can you buy out your lease after bankruptcy in the final 90 days?

A bankruptcy on your record changes how a lender reads your application. It does not, by itself, take the buyout off the table. What matters is your case status, your income today, and starting early enough.

Can you get a lease buyout after bankruptcy?

A lease buyout after bankruptcy is often possible: at heart you are buying a car with a brand-new auto loan, and a bankruptcy on your report does not stop some lenders from reviewing the application. Your case status matters most: a discharged case is generally simpler, while an open Chapter 13 usually needs court or trustee permission before you take on new debt. Approval, rate and term are always the lender’s decision.

The diary below is fiction. Kamala is not a client, and her case, income and loan numbers are imagined purely so the steps have something to hang on.

Days 90 to 61: where did Kamala’s bankruptcy leave her lease?

Kamala leases a Nissan Altima in Connecticut. Her Chapter 7 case was discharged a year and a half before her lease was due to end. She kept a short diary of the last three months, mostly to keep herself from panicking.

Day 90. The lease-end letter arrived. My first thought: does the bankruptcy rule me out of buying the car? I don’t know. I pulled the discharge papers out of the file box so I would stop guessing.

Day 84. Called my attorney. The case is closed and discharged, and nothing is pending. I asked whether I needed anyone’s permission to take on a car loan now; for my discharged case, she said no. She said it would have been different in an open Chapter 13, where new debt usually needs the court or trustee to sign off. I also asked whether the lease itself came through the case intact, since that decides whether I still have a purchase option. It did; I kept it current the whole time.

Day 75. Called the leasing company and got the payoff in writing, dated: $15,400. Looked up the Altima’s value for my trim and mileage, and it came out a bit above that, which should help, since lenders compare the loan with what the car is worth.

Day 62. Pulled my credit reports. Every payment since the discharge shows on time. I wrote down the two old accounts that still say “included in bankruptcy” so I would not be surprised if a lender asked.

Days 60 to 31: what payment could Kamala carry after bankruptcy?

Day 55. Made a table, because the payment matters as much as the approval right now. My price is under Connecticut’s $50,000 line, so the 6.35% tier applies (above $50,000 it would be 7.75%), and there is no local sales tax, which puts tax on the payoff at $977.90. If the lender lets me include it, I would finance $16,377.90. My gross income is $3,800 a month. The 14% APR is made up so I can line the terms up side by side. Nobody offered it, and it says nothing about what rates usually are.

TermMonthly paymentShare of $3,800 incomeTotal interest
48 months$447.55about 11.8%$5,104.51
60 months$381.09about 10.0%$6,487.21
72 months$337.48about 8.9%$7,920.57

The 72-month payment is easiest, but it costs $2,816.06 more in interest than 48 months. I can live with 60. The buyout payment calculator matched my math.

Day 48. Applied. Attached the payoff quote, discharge papers, two pay stubs, ID and proof of insurance, using the buyout documents list so nothing was missing.

Day 41. The lender asked for two months of bank statements. Sent them the same evening.

Day 33. An offer came back. The rate was higher than I had hoped, which I half expected given my history. I compared the total cost, not just the monthly figure, and stuck with the 60-month term.

Days 30 to 0: how did Kamala close her lease buyout with time to spare?

Day 20. The payoff quote had expired while I was gathering bank statements. Asked for a fresh one; it was a few dollars different. Signed the loan documents against the new figure.

Day 12. The lender paid the leasing company. I kept making my lease payment until the leasing company confirmed it had the money.

Day 0. The lease-end date came and went, and the Altima was already mine on paper. Connecticut DMV is handling the title, with the lender listed as lienholder.

Afterward. Starting at day 90 was the best decision I made. If I did it again, I would pull the credit reports and bank statements before even requesting the payoff quote, so the quote would not have run out on me.

What belongs on your own post-bankruptcy buyout checklist?

If the numbers do not work yet, returning the car is a legitimate choice; compare it with your other lease-end options. Other credit situations are covered on our bad-credit buyout page. When you are ready, lease buyout financing starts with one application, handled privately. We coordinate rather than lend, aiming for the best rate possible given your history, and the final call belongs to the lender’s underwriting.

What else do people ask about buying out a lease after bankruptcy?

Can I buy out my lease after bankruptcy?

Often, yes. A buyout is a vehicle purchase, so financing it means a new auto loan, and some lenders do consider applicants with a bankruptcy on file. They look at the whole current picture: income, recent payment history, the size of the loan measured against the vehicle’s market value, and where your case stands. Approval and terms come from lender underwriting, not from any fixed rule.

Can I get a lease buyout loan after Chapter 7?

It may be possible once the case is discharged. A completed case is generally simpler for a lender to evaluate than an open one. Bring your discharge papers, proof of income and a payoff quote, and confirm with your attorney that nothing in the case is still pending.

Do I need court approval to buy out my lease during Chapter 13?

Often, yes. Taking on new debt while a Chapter 13 plan is active usually needs permission from the court or trustee, sometimes through a motion to incur debt. Talk to your attorney or trustee before applying so the loan does not conflict with your plan.

Will bankruptcy affect the rate on my lease buyout loan?

Credit history generally influences the rate a lender offers, but the rate comes from underwriting that weighs your full profile, including income, the term, and how the borrowed sum compares with the vehicle’s worth. No one can tell you the number before a lender reviews the file.

How long after discharge can I apply for a lease buyout loan?

There is no universal waiting period; every lender draws its own line. More time since discharge with on-time payments since then generally helps, so check your credit report and gather your documents before applying.

What if financing is not approved before my lease ends?

Call your leasing company early and ask whether the purchase option stays open for any time after the end date, or whether an extension is available. Those rules are set by the leasing company. If neither is possible, returning the car under the contract is the fallback.

Can a lease buyout loan help rebuild credit after bankruptcy?

Provided the lender passes your payments along to the credit bureaus, the loan builds a fresh record. On-time payments help over time; a late payment on a new loan after bankruptcy hurts, so pick a payment that fits comfortably.
